Eviction notices
Before being forced to leave your home, your landlord must send you an eviction notice.
There are different types of notice depending on your situation.
Private renters
If you're a private renter, your landlord can evict you using either a section 8 or section 21 notice.
A landlord can only give you a section 8 notice if they have a legal reason for wanting to evict you.
The most common way for a private landlord to start the eviction process is with a section 21 notice. This is known as a no-fault eviction as your landlord doesn’t need to provide a reason for wanting to evict you.
The Renters Rights Bill, which is due to come into force by summer 2025, will ban no-fault evictions.
Social housing tenants
If you live in social housing, your landlord must serve you with a notice seeking possession before applying to the court for a possession order.

Housing associations may also be able to serve you with a section 8 notice or a section 21 notice.
Homeowners
If you're a homeowner and have fallen behind on your mortgage payments, as a last resort, your lender can start the repossession process.
